Location Regulations - Litter Regulations - Certificate to Dispense Beverages - Exemptions

Location Regulations:
No permit shall be granted for any premises situated within 300 feet or less distance of a building occupied exclusively as a church or synagogue or public library or public playground or school, except school for business education conducted as a business college or school. Certain exceptions apply for bona fide hotels, motels, railroad cars, fraternal organizations and certain restaurants.

Litter Regulations:
It is unlawful to permit the accumulation of trash, debris, refuse, garbage or discarded or noxious matter either on the inside and/or on the outside of the premises used for the sale of alcoholic beverages.

Certificate to Dispense Beverages Required:
No person shall dispense alcoholic beverages of low or high alcoholic content in any business for on the premises consumption, without having been certified or qualified to do so by the parish council, and without having complied with all requirements. Employees hired to dispense alcoholic beverages shall be required to secure a certificate of qualification immediately prior to their employment. No person holding a permit to sell alcoholic beverages for on the premises consumption, and no agent, associate, employee or representative of any such holder of a permit, shall employ or retail anyone who has failed or refused to obtain a certificate of qualification. However, the holder of a permit to sell alcoholic beverages may dispense alcoholic beverages at that establishment without having a certificate of qualification.

Each applicant having a certificate of qualification to dispense alcoholic beverages in a place licensed for on the premises consumption shall be photographed and fingerprinted by the sheriff's office. Any person legally possessing a certificate of qualification may dispense alcoholic beverages at any alcoholic beverage outlet located within the unincorporated areas of the parish. Any person over the age of 18 years legally possessing a certificate of qualification may be designated as a manager of any alcoholic beverage outlet. Every certificate of qualification shall expire on the anniversary of the birthday of the applicant which is nearest to a date two years subsequent to the issuing of the certificate of qualification unless revoked or suspended.

Exemptions: Persons who are employed in places of business whose main or principal business activity is that of serving food, which shall include both restaurants and cafeterias, are excluded from this requirement. This exclusion does not apply to barmaids, bartenders, cocktail waitresses for those persons whose main business activity is that of serving alcoholic beverages.

Go Cups / Open Containers Prohibited - Consumption on Parking Lot Prohibited and Signage- Alcoholic Beverage Outlet Card -

Go Cups / Open Containers Prohibited:

It shall be unlawful for any retail dealer of alcoholic beverages to sell or otherwise make available "go cups" or other open containers intended for consumption off the premises. Certain exceptions apply.

Consumption on Parking Lot Prohibited:

Any person who holds a retail alcoholic beverage permit pursuant to this article and allows the consumption of alcoholic beverages on the parking lot of such establishment will be held guilty of a misdemeanor.

The city hereby requires businesses that sell alcohol, including but not limited to package liquors, to conspicuously post a sign stating: "Notice: A container of alcohol is prohibited from being opened or consumed, within Gretna city limits, on the streets, sidewalks, or neutral grounds; in or on motor vehicles on the streets, rights-of-way, or neutral grounds; or on any private parking lot."

Alcoholic Beverage Outlet Card Required:

Any person, holding an alcoholic beverage permit, and any agent, employee, representative or servant of any such person shall obtain an alcoholic beverage card from the chief of police of the city. In addition to other qualifications, the person must be of good character and reputation and over 18 years of age.

Employment Permits Required

Location Regulations:

No permit shall be granted for the sale of alcoholic beverages for any premises situated within 300 feet or less distance of a building occupied exclusively as a church or synagogue or public library or public playground or school, except for business education conducted as a business college or school. Certain exceptions apply.

Noise Regulations:

No person holding a retail dealer's permit issued for the sale of alcoholic beverages and no servant, agent or employee of the permittee shall, upon the premises for which such permit was issued, play live or recorded music which is so unreasonably intrusive or offensive as to interfere with the comfortable enjoyment of the property of a person residing within 200 feet of the premises. Certain exceptions apply.

Consumption of Alcohol Outside Prohibited:

No person holding an alcoholic beverage outlet dealers permit of any type, including but not limited to, packaged, retail and wholesale dealer permits issued under this article and no servant, agent or employee of the permittee shall permit the consumption of alcoholic beverages in or on the outside area of the premises in which the alcoholic beverages are sold.

Employment Permits Required:

A person holding a retail dealer's permit issued for the sale of alcoholic beverages and each agent, associate, employee, representative or servant thereof shall, before engaging in the sale of alcoholic beverages appear at the police department for the purpose of having a photograph made, being fingerprinted, and showing proof of correct name, address, and date of birth. A fee of $10.00 shall be paid to the city for each application for such a permit. In addition, each applicant shall pay a fee of $10.00 to the state. Certain exceptions apply.

Municipal of Kenner Ordinances

Location Regulations - ABO Employee Cards Required - Drive-Up Window Sales - Signage Pertaining To The Effects of Alcohol During Pregnancy

Location Regulations:

No permit shall be granted for any premises situated within 300 feet, or less distance, of a building occupied exclusively as a church or synagogue, or public library, or public playground, or school, except a school for business education conducted as a business college or school. Certain exceptions apply.

ABO Employee Cards Required:

Every alcoholic beverage handling employee shall obtain a certificate of qualification or ABO employee card prior to entering into employment on an alcoholic beverage permit holder's premises. Certain exceptions apply.

It shall be unlawful for any alcoholic beverage permit holder to allow any alcoholic beverage handling employee, including, but not limited to, servers, bartenders, managers, dancers, maintenance persons and floorwalkers to be present on the premises when alcoholic beverages or containers thereof are handled, dispensed or consumed on the premises, unless such alcoholic beverage handling employee is in possession of an alcoholic beverage handling employee card.

In addition to other qualifications, the person must be of good character and reputation and 18 years of age or older. All ABO employee cards shall be issued for a term of 2 years and shall expire on the anniversary of the date issued. All applications for renewal may be made within 30 days of the expiration of the old card.

Drive-Up Windows Alcohol Beverage Sales:

It shall be unlawful to distribute, dispense or sell through any opening, window, door or orifice to the exterior of any building, including, but not limited to, commonly described "drive-up windows."

Signage Pertaining To The Effects of Alcohol During Pregnancy:

Each alcoholic beverage permittee shall provide the following warning on an informational sign posted in the restrooms of the permitted facility: "Warning: Drinking alcoholic beverages during pregnancy may cause severe mental and physical birth defects."

Municipal of Westwego Ordinances

Sunday Sales - Location Regulations - Open Container Regulations – Bartender - Barmaid Registration Required

Sunday Closing:

Any and all businesses, persons or firms licensed to and selling, serving or dispensing alcoholic beverages are exempt from complying with the provisions in Louisiana Statues relative to selling alcoholic beverages on Sunday; and said establishments may sell alcoholic beverages at any time not specifically prohibited by law.

Location Regulations:

The mayor and board of aldermen of the City of Westwego shall not issue any new liquor licenses to any applicant for the purpose of operating a bar or lounge within 2,000 feet of any existing bar or lounge. Certain exceptions apply.

The sale and/or purchase and/or consumption of alcoholic beverages within 1,000 feet of a church and/or place of worship, school or playground within the city limits of the City of Westwego is prohibited. Certain exceptions apply.

Open Container Regulations:

It shall be unlawful for any person to drink from or carry any opened container, the contents of which are liquids having an alcoholic content of any amount in or on any public street, sidewalk, square or unenclosed public place within the city limits of the City of Westwego.

Bartender / Barmaid Registration Required:

It shall be unlawful for any person to work as a bartender or barmaid in any barroom, tavern, club, or other establishment where alcoholic beverages are sold and consumed on the premises without first registering with the chief of police of the City of Westwego. Registration as a bartender or barmaid shall be made on forms furnished by the city and filed with the chief of police.
