Hours of Operation - Sunday Sales - Location Regulations -

Hours of Sales:
No establishment or operator of an establishment whose principal business is the sale of alcoholic beverages shall sell alcoholic beverages, and shall cease operation of business and deny public access to the premises, and vacate the public from said premises during the following periods: 2:00 A.M. to 6:00 A.M. - Monday, Tuesday, Wednesday, Thursday, Friday, Saturday, and Sunday. In addition, during the hours set forth above, no alcoholic beverages may be consumed on the premises by any person other than the owner of the establishment.

Fetal Alcohol Syndrome Sign

Hours of Operation:

The hours of operation for all class A, B and R license holders shall be from 5:00 a.m. daily until 2:00 a.m. for the following day for each and every day of operation. It shall be a criminal offense for any holder of such a retail dealer's license/permit, or a servant, agent or employee, to dispense, in any manner, alcoholic beverages between the hours of 2:00 a.m. and 5:00 a.m. of any day. All stores, shops, saloons or any other place of business licensed for the sale of alcoholic beverages in the city shall be closed continuously during these designated closing times. During the prohibited periods, no open containers, glasses, bottles, cans or other containers holding alcoholic beverages shall be allowed anywhere on the licensed premises or property, except in a locked cabinet or cupboard.

Location Regulations:

No license or permit shall be granted to any applicant when the property upon which the business is to be conducted is within a radius of 300 feet of any property used exclusively as a regular church or synagogue, public library, school or orphan's home (except a school for business education conducted as a business college or school and except a state college or university), or within a radius of 300 feet of a public playground or park. Certain exceptions apply.

Employee Permit Requirements:

The following employees are required to submit a fee and obtain a two-year permit from the city: Any person employed in a class A or R licensed retail business who, as a function of his duties, dispenses, sells or serves any alcoholic beverages (is not required for waiters / waitresses employed in a Class R licensed business if their primary function is to take orders for and serve food and food items); and any person employed in a class B licensed retail business who, as a function of his duties, dispenses, sells or serves any alcoholic beverages. In addition to other qualifications, the person must be of good character and reputation and over 18 years of age. It is prohibited for any such employee to consume any alcoholic beverages on the licensed premises during hours of operation of the business or during the normal working hours of this employee (except this does not apply to persons employed in class R licensed businesses).

Fetal Alcohol Syndrome Sign:

Each person holding a license issued under the provisions of this chapter shall post and display in a conspicuous place on each licensed premises a sign which shall clearly read as follows: "WARNING: Drinking alcoholic beverages during pregnancy may cause severe physical or mental birth defects."

Hours of Sales:

No person shall sell alcoholic beverages, including but not limited to wine, beer or liquor, and no establishment whose principal business is the sale of alcoholic beverages shall open for any purpose from 2:00 a.m. to 6:00 a.m. Certain exceptions apply.

Location Regulations:

It shall be unlawful for any person to sell spirituous, intoxicating, vinous or malt liquors within a distance of 300 feet from any church or schoolhouse in the city. Certain exceptions apply.

Noise Regulations:

No person holding an alcoholic beverage retail dealer's permit and no agent, associate, employee, representative or servant of any such person shall do or permit any of the following acts to be done on or about the licensed premises: Play live or recorded music which is so unreasonably intrusive or offensive as to interfere with the comfortable enjoyment of the property of a person residing within 200 feet of the premises.
