Hours of Operation - Sunday Sales – Exceptions - Location Regulations - Noise Regulations – Open Containers - Dispensers Certificate

Hours of Sales:
All businesses, establishments, persons, firms or corporations who are licensed by the Parish of St. Tammany to sell or dispense alcoholic beverages at retail, pursuant to a Class A permit, shall close their doors to entry at 2:00 a.m. daily and shall remain closed until 6:00 a.m. daily. No such Class A permittee, licensed for the retail sale of alcoholic beverages for consumption on the premises shall sell alcohol between the hours of 2:00 a.m. and 6:00 a.m. daily.

Exceptions:
These closing hours do not apply on the following days: January 1, the Saturday and Monday preceding Mardi Gras Day and Mardi Gras Day itself.

Restaurants and cafeterias, which derive 60% or more of their total business from the sale of food items, shall be exempt from these closing hours; provided however, that such restaurants or cafeterias shall be prohibited from selling or dispensing alcoholic beverages between the hours of 2:00 a.m. and 6:00 a.m. daily.

All businesses, establishments, persons, firms or corporations who are licensed by the Parish of St. Tammany to sell alcoholic beverages at retail for off-premise consumption, pursuant to a Class "B" permit, shall be exempt from these closing hours; provided however that such retail outlets shall be prohibited from selling or dispensing alcoholic beverages between the hours of 2:00 a.m. and 6:00 a.m. daily.

Location Regulations:
No permit required by the provisions of this Article shall be granted for any premises situated within 500 feet or less distance of a building occupied exclusively as a church, or synagogue, public library, public playground or school, except a school for business education conducted as a business college or school.

Noise Regulations:
No person in any Ward of St. Tammany Parish holding a retail dealer's permit and no agent, associate, employer, servant or representative of any such person shall do or permit any of the following acts to be done on or about the licensed premises: Permit or allow playing of live or recorded music and/or permit or allow any loud noise or nuisance which is so unreasonably intrusive or offensive as to interfere with the comfortable enjoyment or use of the property of a person residing in the area of the licensed premises in violation of Louisiana Air Control Law.

Open Containers :
No holder of a permit for the retail sale of alcoholic beverages shall knowingly permit any individual, whether patron, customer, employee or otherwise, to remove any alcoholic beverage from the premises in a container of any type, unless said container is unopened and sealed. No person, whether patron, customer, employee or otherwise, shall remove any alcoholic beverage from the premises of a holder of a permit for the retail sale of alcoholic beverages in a container of any type, unless said container is unopened and sealed. All holders of permits for the sale of alcoholic beverages shall post a conspicuous notice inside their premises, as well as by each exit, stating that it is illegal to remove any alcoholic beverages from the premises in any type of unsealed or open container of any kind, and that said violators shall be subject to fine and/or imprisonment as provided in parish ordinances. This does not apply to the Saturday and Monday proceeding Mardi Gras Day and Mardi Gras Day itself.

Dispensers Certificate:
No person or manager or supervisor of any person shall dispense beverages of any alcoholic content in any business licensed to sell alcoholic beverages without having been certified or qualified to do so by the Sheriff of St. Tammany Parish and without having complied with all requirements. Each applicant desiring a certificate of qualification to dispense alcoholic beverages shall be photographed and finger printed by the Sheriff s Department of this Parish. In addition to other qualifications, the person must be of good character and reputation and 21 years of age to dispense and/or sell alcohol in any business establishment having a valid Class A Parish liquor license. Applicants must also have completed the St. Tammany Parish Sheriff's course entitled "Responsible Alcohol Service" or the Louisiana Office of Alcohol and Tobacco Control Approved Provider Responsible Vendor Program.

Municipal of Covington Ordinances

Legal Hours of Operation - Sunday Sales – Location Regulations - Removal of Alcoholic Beverages - Possession of Firearms

Hours of Sales:

It shall be unlawful for any person, firm or corporation who or which has been issued a permit to sell alcoholic beverages, or any employee, servant or agent or representative of such permittee to sell, serve, offer to sell, give or dispense any alcoholic beverage between the hours of 2:00 a.m. and 6:00 a.m. No bars, barrooms, lounges, nightclubs, saloons, restaurants or other types of businesses licensed for retail sale of alcoholic beverages for consumption on the premises shall remain in operation and allow any person, other than an employee of the permittee, to remain on its premises between the hours of 2:00 a.m. and 6:00 a.m. No holder of a permit for the retail sale of alcoholic beverages not intended for consumption on the premises shall sell or otherwise dispense any alcoholic beverage between the hours of 2:00 a.m. and 6:00 a.m. This shall not apply to retail sales on the following days: January 1 and on the day Daylight Savings Time changes. Hours on January 1 will be extended to a 3:00 a.m. closing. Hours on the day Daylight Savings Time changes will be extended for one hour.

Location Regulations:

All alcoholic beverage businesses are prohibited within 300 feet of a church, synagogue, public library, public playground or school.

Removal of Alcoholic Beverages :

No holder of a permit for the retail sale of alcoholic beverages intended for consumption on the premises or an employee of such holder shall knowingly permit any individual, whether patron, customer, employee or otherwise, to remove any alcoholic beverage from the premises in a glass container. No person, whether patron, customer, employee or otherwise, shall remove any alcoholic beverages in a glass container from the premises of the holder of a permit for the retail sale of alcoholic beverages for consumption on the premises. Certain exceptions apply.

Any holder of a permit for the retail sale of alcoholic beverages for consumption on the premises shall post a conspicuous notice inside his premises, as well as by each exit, stating that it is illegal to remove any alcoholic beverages intended for consumption on the premises from the premises in any glass container of any kind and that violators shall be subject to fine and/or imprisonment under city ordinance.

Possession of Firearms :

It shall be unlawful for any person to have in his possession a firearm or other dangerous weapon, while in any premises where alcoholic beverages, including beer, whiskey or any other beverage are sold and consumed on the premises, except this requirement shall not be applicable to the owner or lessee of the premises or their employees when properly authorized, or to sheriff's deputies, state police, city police, constables, town marshals or other persons vested with police power when in actual discharge of their duties.

Municipal of Mandeville Ordinances

It shall be unlawful for any person, firm or corporation who has been issued a permit to sell alcoholic beverages or beer, or any employee, servant, or agent or representative of such permittee, to sell, serve, offer to sell, give or dispense any alcoholic beverage between the hours of 2:00 a.m. and 6:00 a.m.

No bars, bar rooms, lounges, nightclubs, saloons, restaurants or other types of businesses licensed for the retail sale of alcoholic beverages for consumption on the premises shall remain in operation and allow any person, other than an employee of the permittee, to remain on its premises between the hours of 2:00 a.m. and 6:00 a.m.

No holder of a permit for the retail sale of alcoholic beverages not intended for consumption on the premises shall sell or otherwise dispense any alcoholic beverage between the hours of 2:00 a.m. and 6:00 a.m.

This section shall not apply on the following days: January 1, the Saturday and Monday mornings preceding Mardi Gras day, and Mardi Gras day itself.

Location Regulations:

It shall be unlawful for any person to sell or offer for sale any alcoholic beverages of an alcoholic content of more than 0.5% by volume on Lakeshore Drive within the city, except on such portions of said Lakeshore Drive as shall be declared an open zone, and under such conditions as are set forth. It shall be unlawful for any person to sell or offer for sale any alcoholic beverage of an alcoholic content of more than 0.5% by volume, on the beach, which forms the south line of Lakeshore Drive to the water's edge, nor shall any sale be permitted on any pier or landing extending from said beach over the waters of Lake Pontchartrain.

It is unlawful for any person to sell alcoholic beverages of an alcoholic content of more than 0.5% by volume for consumption on the premises within a distance of 300 feet of any church, synagogue, public library, school, or public playground. Certain exceptions apply.

Noise Regulations:

No person holding a retail dealer's permit and no agent, associate, employee, representative, or servant of any such person shall do or permit any of the following acts to be done on or about the licensed premises: Play live or recorded music which is so unreasonably intrusive or offensive as to interfere with the comfortable enjoyment of the property of a person residing within 200 feet of the premises.

Removal of Beverages :

No holder of a permit for the retail sale of alcoholic beverages intended for consumption on the premises shall knowingly permit any individual, whether patron, customer, [or] employee, to remove any beverages from the premises in an open container of any type. No person, whether patron, customer, [or] employee, shall remove any alcoholic beverages from the premises of the holder of a permit for the retail sale of alcoholic beverages for consumption on the premises in an open container of any type.

Any holder of a permit for the retail sale of alcoholic beverages for consumption on the premises shall post a conspicuous notice inside his premises as well as by each exit stating that it is illegal to remove any alcoholic beverages intended for consumption on the premises in an open container of any type and that violators shall be subject to fine and/or imprisonment under city ordinance.

Possession of Weapons:

It shall be unlawful for any person to have in his possession a firearm or other instrumentality customarily used or intended for probable use as a dangerous weapon in any premises where alcoholic beverages are sold and consumed on the premises; except the owner or lessee of the premises or their employees, sheriffs, deputy sheriffs, state police, city police, constables, city marshals or persons vested with police power when in the actual discharge of their duties.

Municipal of Slidell Ordinances

Hours of Operation:

All businesses, persons or firms permitted to and selling, serving or dispensing alcoholic beverages at retail within the city limits are hereby exempted from the effect and operation of the provisions of R.S. 51:191 and 51:192 so that any such persons, firms or businesses permitted to, may sell, serve or dispense alcoholic beverages at retail on Sunday.

All businesses, persons or firms who are permitted to sell or dispense alcoholic beverages at retail by-the-drink shall close their doors to entry at 2:00 a.m. daily and remain closed until 6:00 a.m. daily. No bar, barrooms, lounges, nightclubs, saloons or other types of businesses permitted for the retail sale of alcoholic beverages for consumption on the premises shall remain in operation or allow any persons other than the employees of the permittee to remain on its premises between the hours of 2:00 a.m. and 6:00 a.m. daily. This section shall not apply on the following days: January 1, the Saturday and Monday morning preceding Mardi Gras Day and Mardi Gras Day itself. Qualified restaurants or cafeterias where at least 60% or more of their total business is in the sale of food shall be exempt from this section, except that they shall be prohibited from dispensing alcoholic beverages by the drink between 2:00 a.m. and 6:00 a.m. daily.

No holder of a permit for the retail sale of alcoholic beverages not intended for consumption on premises (packaged sales) shall sell or otherwise dispense any alcoholic beverages between the hours of 2:00 a.m. and 6:00 a.m. daily.

Location Regulations:

All alcoholic beverage dealers, excepting bona fide restaurant/cafeterias and public markets, are prohibited within 300 feet of a church, synagogue, library, playground or school. Certain exceptions apply.

Open Containers:

No holder of a permit for the retail sale of alcoholic beverages intended for consumption on the premises shall knowingly permit any individual, whether patron, customer, employee or otherwise, to remove any alcoholic beverage from the premises whether in a container made of glass, bottle, can, paper or plastic cup, go-cup, or otherwise unless such container is unopened and sealed. No person, whether patron, employee, customer, or otherwise, shall remove any alcoholic beverage from the premises of the holder of a permit for the retail sale of alcoholic beverages for consumption on the premises in a container of any type, whether glass, bottle, can, paper or plastic cup, go-cup, or otherwise unless such container is unopened and sealed. Certain exceptions apply.

Certificates of Qualification:

No person shall dispense alcoholic beverages in any business permitted under the ordinances of the city for on-the-premises consumption except those possessing solely a beer permit, without having been certified or qualified to do so by the St. Tammany Parish Sheriff's Department. In addition to other qualifications, the person must be of good character and reputation and over 18 years of age.

Drive-Up Windows Are Prohibited:

Drive-up windows and/or drive-through buildings shall be prohibited for any commercial establishment selling and/or dealing in alcoholic beverages.

Municipal of Abita Springs Ordinances

It shall be unlawful for any person, firm or corporation who has been issued a permit to sell alcoholic beverages or beer, or any employee, servant, or agent or representative of such permittee, to sell, serve, offer to sell, give or dispense any alcoholic beverage between the hours of 2:00 a.m. and 6:00 a.m. No bars, barrooms, lounges, night clubs, saloons, restaurants or other types of businesses licensed for the retail sale of alcoholic beverages for consumption on the premises shall remain in operation and allow any person, other than an employee of the permittee, to remain on its premises between the hours of 2:00 a.m. and 6:00 a.m. No holder of a permit for the retail sale of alcoholic beverages not intended for consumption on the premises shall sell or otherwise dispense any alcoholic beverages between the hours of 2:00 a.m. and 6:00 a.m. This section shall not apply on the following days: January 1, the Saturday and Monday mornings preceding Mardi Gras Day, and Mardi Gras Day itself and Thanksgiving Day.

Location Regulations:

No person or persons shall conduct any place of business for the sale of alcoholic beverages of high or low alcoholic content within a distance of 300 feet of any school property, public or private, or any church property or playground within the town.

Removal of Beverages:

No holder of a permit for the retail sale of alcoholic beverages intended for consumption on the premises shall knowingly permit any individual, whether patron, customer, employee or otherwise to remove any beverage from the premises, whether in a closed container, glass, bottle, can, paper cup, "go cup" or otherwise.

No person, whether patron, customer, employee, or otherwise, shall remove any alcoholic beverages from the premises of the holder of a permit for the retail sale of alcoholic beverages for consumption on the premises, whether in a closed or open container of any type, whether glass, bottle, can, paper, or plastic cup, "go cup", or otherwise.

Any holder of a permit for the retail sale of alcoholic beverages for consumption on the premises shall post a conspicuous notice inside his premises as well as by each exit, stating that it is illegal to remove any alcoholic beverages intended for consumption on the premises from the premises in any container of any kind, and that violators shall be subject to fine and/or imprisonment under city ordinance.
