Hours of Operation - Sunday Sales – Ward 1 – Ward 2 – Ward 3 – Location Regulations

Hours of Operation:
In all unincorporated areas throughout Livingston Parish, Louisiana, all stores, shops, saloons, or any other place of business that is authorized to sell alcoholic beverages shall suspend sales of alcoholic beverages from Sunday - Thursday at 1:00 a.m. and shall be closed from 1:00 a.m. until 8:00 a.m. the same day; on Friday and Saturday, sale of alcoholic beverages shall be suspended at 2:00 a.m. and shall be closed from 2:00 a.m. until 8:00 a.m. the same day.

Restaurants, grocery stores, drug stores, or other exempted businesses may remain open for the sale of other items permitted by law. Except as otherwise provided herein, any sale or consumption of alcoholic beverages in such places of business during the prohibited periods above set forth, unless exempted by this part, is expressly prohibited.

WARD 1--Sales Regulated:
The sale of alcoholic beverages containing more than 3.2% alcohol by weight is prohibited in Ward 1.

WARD 2--Sales Regulated:
Except within the incorporated limits of the Village of Port Vincent, the sale of alcoholic beverages containing more than 3.2% alcohol by weight is prohibited in Ward 2.

WARD 3--Sales Regulated:
Except within the incorporated limits of the Village of French Settlement, the sale of alcoholic beverages containing more than 3.2% alcohol by weight is prohibited in Ward 3.

Location Regultions:
No permit shall be granted to any applicant when the premises in which the business is to be conducted is situated within 500 feet of a building used exclusively as a regular church or synagogue, public library, public playground, school or orphans' home (except a school for business education conducted as a business college or school). Certain exceptions apply to bona fide hotels, railways cars, and fraternal organizations.

Hours of Sales:

All stores, shops, restaurants, bars, and other places of business shall suspend sales of alcoholic beverages at 2:00 a.m., and shall be closed at 2:30 a.m. continuously until 6:00 a.m. on the same day. However, all such places of business shall close at 2:30 a.m. on Sunday and remain closed until 6:00 a.m. on the following Monday, except as follows:

Exceptions:

Businesses that hold a retailers Class B (package sales) permit or a retailers Class B (six percent or less alcohol content) (package sales) permit, and that realize at least 60 percent of their monthly revenues from the sale of merchandise other than alcoholic beverages, may be open for business and sell beer and other alcoholic beverages as authorized under their permits between 12:00 noon and 12:00 midnight on Sunday; Restaurant establishments that hold a retailers Class A-R (restaurant) permit may be open for business and sell alcoholic beverages as authorized under their permits, in connection with the serving and selling of meals, between 11:00 a.m. and 12:00 midnight on Sunday, and between 11:00 a.m. on New Year's Eve and 2:00 a.m. on the following day whenever New Year's Eve falls on a Sunday; and Businesses that hold a retailers Class A-G (general bar) permit may be open for business and sell alcoholic beverages as authorized under their permits between 8:00 p.m. on New Year's Eve and 2:00 a.m. on the following day whenever New Year's Eve falls on a Sunday, and between 11:00 a.m. and 12:00 midnight on "Super Bowl Sunday".

Closing Hours:

All stores, shops, restaurants, and other places of business not required to be closed by other provisions of law may remain open for the sale of items permitted by law other than alcoholic beverages. Except as otherwise provided in this section, any sale or consumption of alcoholic beverages in such places of business during the prohibited periods is expressly prohibited.

Location Regulations:

All alcoholic beverage businesses are prohibited within 300 feet of a church, synagogue, library, playground, or school.

Servers & Sellers Permits Required:

It shall be unlawful for any person to work as a server or seller of alcoholic beverages in any barroom, tavern, club, store or other establishment where alcoholic beverages are sold or consumed on the premises, without first making, in person, application and securing a permit for such work. In addition to other qualifications, the person must be of good character and reputation and over 18 years of age. The permit shall be renewed every other year on or before the applicant's birthday.

Possession of Weapons:

It shall be unlawful for any person to have in his possession a firearm or other instrumentality customarily used or intended for use as a dangerous weapon on any premises where alcoholic beverages are sold or consumed on the premises except the owner or lessee of the premises or their employees, sheriffs, deputy sheriffs, state police, city police, constables, town marshals, or persons vested with police power in the city.

Hours of Operation:

The hours of operation of all Class A, B, and R license holders shall be from 6:00 a.m. daily until 2:00 a.m. of the following day, Mondays through Saturdays.

Sunday Sales:

Class A license holders shall be allowed to operate and sell alcoholic beverages on Christmas Eve and New Years Eve (if such dates fall on a Sunday) and Super Bowl Sundays, between 11:00 a.m. on such Sunday and 2:00 a.m. on the following day. No alcohol may be served, consumed or sold until 11:00 a.m. and the premises must be vacated by 2:00 a.m. the following day. Whenever New Years Eve falls on a Sunday, all Class A license holders shall be allowed to operate between the hours of 8:00 p.m. on New Year's Eve until 2:00 a.m. the following day. No alcohol shall be served, consumed or sold until 8:00 p.m. and the premises must be vacated by 2:00 a.m. the following day. All Class A license holders shall be allowed to operate the hours of 11:00 a.m. until 12:00 midnight on "Superbowl Sunday". No alcohol shall be served, consumed or sold until 11:00 a.m. and the premises must be vacated by 12:00 midnight.

Class B alcoholic beverage license/permit retail dealers may sell alcoholic beverages 11:00 a.m. Sunday to 12:00 midnight Sunday.

Class R (restaurant) permit holders may sell beverages between the hours of 11:00 a.m. Sunday and 12:00 midnight Sunday in connection with the serving and selling of meals and provided that all provisions pertaining to Class R permits are met and that no bar or lounge be opened to the general public during the same period.

Closing Hours:

Any places of business shall be closed at 2:00 a.m. continuously until 6:00 a.m. the same day and shall be closed at 2:00 a.m. Sunday and shall be closed on Sundays from 2:00 a.m. to 11:00 a.m., except as otherwise allowed.

Location Regulations:

It shall be unlawful for any person to possess, sell, or distribute any alcoholic beverage or intoxicating beverages on the grounds, premises, or any building of any public or private school premises, playgrounds, or church property in the town.

No permit shall be granted for any premises situated within 300 feet or less of a public playground or of a building used exclusively as a church or synagogue, public library, school, fulltime day care center, or correctional facility housing inmates, including but not limited to a halfway house, unless a waiver has been granted.

Zoning:

Any and all Class A, Class B or Class R license holders are allowed only in the RC zoning designation. Class R license holders are allowed only in the RC-CAB-1 zoning district. Class A license holders are allowed only in the RC-CAB-2 zoning district.

Classified Employee License Required:

Any person employed or used in a Class A or R licensed retail business who, as a function of their duties, dispenses, sells or serves any alcoholic beverages shall be required to be licensed. This includes bartenders, barmaids, waiters, waitresses, cocktail waiters, and cocktail waitresses. Managers, bouncers, doormen, and disc jockeys are also required to obtain a classified employee license.

Retail Clerk License Required:

Any person employed or used in a Class B licensed retail business who, as a function of their duties, dispenses, sells or serves any alcoholic beverages is required to obtain a retail clerk license. This includes managers, sales clerks, retail clerks, and check-out counter clerks.

Waiter / Waitress License Required:

Any person employed or used in a Class A or R licensed retail business whose primary function is to take orders for and serve food and food items and who also takes orders or serves alcoholic beverages in conjunction with the serving of those meals is required to have a waiter / waitress license.

No permittee shall serve or sell any alcoholic beverages between the hours of 10:30 p.m. and 6:00 a.m. every day.

Location Regulations:

No permit shall be granted for any premises situated within 300 feet of any public playground, or of a building used exclusively as a church, synagogue, public library or school, full-time day care center, or a correctional facility housing inmates, including, but not limited to, a halfway house. Certain exceptions apply.
